


STANDARD TERMS & CONDITIONS
OF HIRE (unless otherwise agreed in writing):In all cases
these conditions of hire form the basis of your contract with Maesmor
Hall Farm Cottages. BOOKING: Bookings are from Saturday
to Saturday, unless otherwise agreed in writing. Arrival time is from
3pm and departure time is 10am at the latest. By booking, you agree
to leave the cottage(s) clean and tidy and you are responsible for
any loss or damage sustained during your stay.The booking will be deemed
to have been accepted from the person in whose name the deposit is
sent. Any other members of the party will be deemed to be guests of
this person and his/her family. DEPOSIT: Your booking
becomes firm when a deposit of 20% of the total rental price has been
received and cleared by us.Until then, it will be a provisional booking
that we will hold for one week (seven days) from the date you make
it. CONFIRMATION: Your booking will be confirmed by
us in writing, or by email, once your deposit has been received and
cleared. Please let us know if you have not received such confirmation
ten days after sending your deposit. A binding contract between us
(Maesmor Hall Farm Cottages and
the person in whose name the deposit has been sent - see above) will come
into existence once your deposit has been received and cleared by us.
PAYMENT:
The full balance of the total rental price is due and payable six weeks
before your holiday begins. If the full amount is not paid on time, we
reserve the right to cancel your booking and your deposit will be forfeit.
If you book a cottage within six weeks of the start date, the full amount
is due and payable when you make your booking. Payment may be made by
cheque or BACs. The contract shall be subject to English law and we both
agree to submit any dispute to the exclusive jurisdiction of the courts
of England and Wales. NUMBER IN YOUR PARTY: It is a
condition of your booking that the total number in your party shall not
exceed the capacity of the property as advertised: babies under two are
not normally counted as a member of your party. The use of tents or sleeping
in motor vehicles adjacent to the property is not allowed. CANCELLATION:
If you have to cancel your holiday, let us know as soon as possible.
If you cancel, you are still liable for the payment of the balance due
in full. We will endeavour to re-let your holiday and if we are able
to do so before you pay your balance in full, you will lose only your
booking deposit. If we are able to re-let after you have paid your balance
in full, we will refund the whole or part of that money up to a maximum
of the amount we receive on re-letting. LINEN
AND TOWELS: Bed linen, including sheets, pillows and duvets,
is provided. One bath and one hand towel per person are also provided.
In addition to these, please feel free to bring your own.
AVAILABILITY:
Your booking is accepted on the understanding that your confirmed property
will be available for your use on the agreed date. Very occasionally, force
majeure (see below) may make this impossible. When this arises, we have
the right to cancel your booking. In this event, we will endeavour to offer
you an alternative property, if available. If we cannot do so, or if you
do not wish to accept the alternative we offer, we will refund all monies
you have paid to us in full. Where any cancellation or change results from
force majeure as defined below, our liabilities are limited to offering
you an alternative property (where available) or full refund as set out
above. We regret we cannot pay any compensation or meet any expenses or
costs you may incur as a result of any such cancellation or change. Circumstances
amounting to force majeure include any event which we could not, even with
all due care, foresee or avoid. Such circumstances include the destruction
or damage of the property (which cannot reasonably be remedied to a satisfactory
standard before the start of your holiday) through fire, flood, explosion,
storm or other weather damage, break-in, criminal damage or any similar
event beyond our control. Such circumstances also include riots or civil
strife, industrial action, natural or nuclear disaster, fire, adverse weather
conditions, war or threat of war, actual or threatened terrorist activity
and all similar situations beyond our control. We (the owners) have the
right to refuse accommodation to any person(s) who, in our reasonable opinion,
is not suitable to complete the holiday because of their unreasonable behaviour,
damage to property or danger or significant annoyance to others. In these
cases, the contract may be terminated and we will have no further liability.
You will remain liable to pay the hire price and no refund shall be due. DAMAGE
TO THE PROPERTY: The hirer shall be liable for any damage caused
to the property during the period of hire. We (the owners) have the right
to enter any accommodation (without prior notice if this is not practical
or possible) if special circumstances or emergencies arise (for example
if repairs need to be carried out).
SWIMMING
POOL: Children
must be accompanied by a responsible adult at all times when using the
swimming pool. We reserve the right to close
and/or withdraw use of the swimming pool without prior notice should unforeseen
circumstances arise. WHEELCHAIR/DISABLED PERSONS:
It is essential that all booking applications from parties including people
with special needs give us written details of those needs. PETS:
Unfortunately, we cannot accept pets of any sort in the cottages except for
registered assistance dogs which will be accepted free of charge, subject
to availability of suitable accommodation. SMOKING: Our
cottages are strictly no smoking. If anyone is found to be smoking inside
the properties, the contract will be terminated and the group/party asked
to leave. In this event, we will have no further liability, you will remain
liable to pay the hire price and no refund shall be due. VEHICLES:
Your vehicles, their accessories and contents are left entirely at your risk.
We (the owners) will not be responsible for any loss or damage from or to
any vehicle from any cause whatsoever other than in the case of our negligence. PERSONAL
HOLIDAY INSURANCE: You should obtain your own insurance
cover for your holiday.
